Q. What can You do about noisy neighbors in your building?

A. NYC is a noisy town, but that doesn’t mean you have to tolerate a noisy neighbor. As a general matter of law, all tenants have an absolute right to quiet and peaceful enjoyment of their apartments based on a NY State law entitled the “Warranty of Habitability.” See Real Property Law § 235-b. In addition, many leases contain rules that specify the “quiet” hours and the amount of floor that must be carpeted.  The following items explain approaches that may help to resolve the problem of noisy neighbor.
